Welcome to VintageDrivingMachines.com. By using this Web site, you accept the terms of our Visitor Agreement. This is a legally binding agreement between you and Vintage Driving Machines. You should read it carefully.

General Provisions

Vintage Driving Machines respects your privacy. Please take a moment to review our separate Privacy Policy.

We invite you to let us know of information on our site that you believe may be inaccurate. Please forward a copy of the material to our Customer Service Manager, along with an explanation of your reasoning to admin@vintagedrivingmachines.com.

If you are an owner of intellectual property and believe that your property has been improperly posted, displayed or distributed via this Web site, please notify us immediately at admin@vintagedrivingmachines.com as provided in our "Listings You Post" section below.

Using Our Web Site

Our mission is to put willing buyers of collector automobiles in touch with willing sellers of such vehicles. We therefore provide a vehicle listing and information service using information supplied by the seller, not by Vintage Driving Machines. We hope that all who use our services will act honorably and treat others fairly, but we can neither verify the information sellers supply to us nor guarantee the condition, authenticity or quality of the vehicles they offer. Similarly, we cannot assure any seller of any vehicle that a check from a buyer will clear. When using this Web site to find either a buyer or a seller of a vehicle, we urge you to use the same common sense and good judgment you would use in selling an automobile through, or responding to, a classified advertisement in the newspaper.

We seek to ensure that all prices and information posted on our Web site are accurate at all times. However, we cannot be responsible for any typographical or other errors that may appear. If the posted price for a vehicle or service is incorrect due to typographical or other error (such as an error in data transmission), we will not be liable for the error but we will endeavor to correct the information as soon as we become aware of the error. We reserve the right to refuse or cancel any postings submitted or listed at an incorrect price.

Please note that prices listed by sellers may not include taxes, title and license charges, regulatory fees, emissions testing and compliance fees or other fees that may be added to the advertised price in determining the final sale price of a particular vehicle.

Before purchasing or selling any vehicle (or other goods or services related to the maintenance and upkeep of such vehicles) you should confirm with the other party any information - including price, financing, and manner and method of delivery - that is important to your purchasing or selling decision.

That said, we do our best to ensure that the information on our Web site is accurate and our users are encouraged to be honest and responsible in their descriptions of their listed items. Should you have any information to the contrary, we urge you to report it to us.

We ask that payment for our advertising services be made via accepted credit cards as indicated on the payment submission page. We typically post new advertisements within one business day following submission of all the listing forms.

Sellers offering vehicles for sale through our Web site must be prepared to sell the vehicle for the price and other terms they list. Sellers must have possession of the actual vehicle listed and have the ability to transfer title. To list a vehicle for sale on our site, we require sellers to provide certain identifying and contact information. The information must accurately identify the seller and the method of contact must permit buyers to communicate directly with the seller.

Sellers advertising on our Web site are not permitted to charge any potential buyer for information concerning a vehicle listed for sale, nor are they permitted to use our Web site to promote, without our prior written permission, any other Web site, product or service.

No more than one vehicle may be advertised in a given advertisement, regardless of the duration of the advertisement. Persons who wish to sell more than one vehicle must purchase a separate advertisement for each. For this reason, sellers are not permitted to change the reference to the make, model, year, identification number, or other identifying information of a vehicle after the advertisement has been posted on our Web site. Sellers should always double check the information in their advertisements before submitting them.

Links to Other Sites

For your convenience, and as a service to our visitors, we make available a variety of links to other Web sites that we do not operate. Through them you may be able to obtain important products and services, including insurance, warranties, financing and inspection services. We do not endorse the particular service providers and we cannot guarantee the prices, terms, quality, reliability or performance of the products or services such third-party vendors may provide. We are not responsible for their products or services. If you choose to purchase an inspection through a third-party Web site, remember that an inspection is not a warranty. Also, an inspection is not a guarantee that the vehicle inspected is free of defects or that the inspectors have identified all existing defects. Before purchasing any inspection service, you should confirm with the inspector the location where the inspection will be conducted, the scope and price of the inspection, and any other information you consider important to your decision. You release Vintage Driving Machines from any damages that you may incur, and agree not to assert any claims against us, arising out of your purchase or use of products or services supplied by third parties.

Listings You Post

You may create and submit your own listing for your vehicle. By submitting any material to be uploaded onto our site, you represent and warrant that your submission does not contain any computer virus, worm, or other damaging computer file or code. You further represent and warrant that you own or otherwise control all rights (including any copyright, trademark, service mark, trade secret, patent, privacy, right of publicity, or other similar right) to the content that you submit. You further represent that the content is accurate; does not violate any applicable law; regulation or rights of any third party; and will not cause injury to any to any person or entity. You agree to indemnify and hold harmless Vintage Driving Machines, its affiliates and service providers (and all their respective owners, officers, directors, employees, agents, independent contractors, and representatives) from all claims, demands, damages and costs (including attorneys' fees) resulting from content you submit.

By submitting content to Vintage Driving Machines, you are permanently granting us, our affiliates, successors, assigns, and licensees, all rights to the material, including a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, sell, distribute, and display such content throughout the world in any medium without compensation to you, and to maintain the material in an archive. We may use listings data to derive information useful to buyers and sellers of vehicles, such as vehicle valuation information, supply and distribution.

Even though we cannot monitor all the listings and content posted to our Web site, we nonetheless reserve the right (but assume no obligation) to delete any information or advertisements that we consider unacceptable or inappropriate, whether for legal or other reasons. We also comply with the terms of the Online Copyright Infringement Liability Limitation Act (OCILLA) and will take down any postings that are alleged, under penalty of perjury, to contain content owned by others we are provided with (i) the complaining party's contact information; (ii) an identification of the copyrighted material; (iii) a statement that the complainant has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; (iv) a statement that the information in the notification is accurate; (v) a statement under penalty of perjury that the complainant is the copyright holder or is authorized to act for the copyright holder; and (vi) the complainant's signature. Upon receipt of such a complaint, we will take down the challenged page. If, however, we are then provided with (i) the posting party's contact information; (ii) the identification of the removed advertisement; (iii) a statement under penalty of perjury that the posting party has a good faith belief that the material was taken down mistakenly; (iv) a statement consenting to the jurisdiction of the posting party's local United States District Court, or, if outside the United States, to a United States District Court in any jurisdiction in which we may be found; and (v) the posting party's signature, we will notify the complainant and wait fourteen business days for the complainant to initiate a lawsuit regarding the posting. If the complainant fails to do so, we will put the challenged material back up. We further reserve the right to take down and refuse to accept further advertisements placed by persons who have been repeatedly challenged for posting advertisements containing the copyrighted material of others. In addition we also reserve the right to take down and refuse to accept further advertisements placed by persons who have been repeatedly challenged for posting misleading advertisements or listings.

Other Improper Activities

We do not permit spamming or data scraping. We want buyers visiting VintageDrivingMachines.com to feel free to share their e-mail addresses with our advertisers. By listing a vehicle for sale, you agree to use the e-mail addresses of those responding to your listing or advertisement only to communicate with them concerning the potential sale of that vehicle or the provision of goods or services related to it. By using our Web site, you agree not to use information concerning other users of our Web site, or the vehicles they have listed or searched for on this Web site (including listing information, user names, e-mail addresses, telephone numbers, or other information), for any purpose other than as stated above. This Visitor Agreement has been made in, and will be construed in accordance with the laws of, the State of California. By using this Web site, you consent to the exclusive jurisdiction and exclusive venue of the state and federal courts in Los Angeles County, California in all disputes arising from or related to this Agreement or the use of this Web site.

Limitations on the Use of Our Site

Without limiting any other provisions of our Visitor Agreement, you agree not to access, monitor or copy any content or information from our Web site using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission given in advance. You further agree not to take any action that imposes or may impose, as we determine in our sole discretion, an unreasonable or disproportionate burden on our infrastructure. In addition, you agree not "frame," "mirror" or otherwise incorporate any part of our Web site into any other Web site without our express written permission given in advance.

Registration

To obtain access to certain of our services, you will be given an opportunity to register with VintageDrivingMachines.com. As part of the registration process, you must select a user name and password. You agree that the information you supply during the registration process will be accurate and complete and that you will not register under the name of, or attempt to enter the service under the name of, another person. We reserve the right to disallow the use of any user name that we deem offensive or inappropriate. You will be responsible for preserving the confidentiality of your password and for all actions of persons accessing VintageDrivingMachines.com through any user name/password assigned to you. You must notify us immediately of any known or suspected unauthorized use of your account.
